Terms and Conditions of Sale
These General Terms and Conditions of Sale govern the commercial relationship between the seller, WINEUPONATIME / GRECOR Sàrl, and the buyer. They form an integral part of the general conditions of use of this website.
By placing an order on this site, the buyer acknowledges having read, understood and accepted these Terms and Conditions without reservation. In case of disagreement with any of these provisions, the buyer must refrain from placing an order on this site.
We reserve the right to amend these Terms and Conditions at any time and without prior notice by publishing a new version on this site.
1. Legal Age for the Sale of Wine and Spirits
By placing an order, the customer confirms being at least 16 years old to purchase wine and at least 18 years old to purchase spirits.
The sale of wine to persons under 16 and the sale of spirits to persons under 18 is prohibited under Swiss law.
For other countries, only individuals who have reached the legal drinking age in their country may access and purchase from the site.
It is the buyer’s responsibility to verify the legality of such purchase in their country of residence.
2. Product Availability
Product availability is subject to stock levels. The buyer will be informed in the event of a product being unavailable.
Some wines are available in very limited quantities, sometimes in single-bottle stock.
3. Pricing
Prices are listed per bottle, in Swiss Francs (CHF), tax included (TTC), ex-cellar from Chamoson, Switzerland.
4. Visuals
Images and product photos on the site are non-contractual.
We strive to provide real images of the bottles offered. However, for cases such as full cases (e.g., 12 bottles) or bottles stored for many years, variations may occur.
Bottles are stored in a humidity-controlled cellar, and natural aging can result in stains, label wear, or other cosmetic changes.
Because of this:
- The condition of the bottles is considered when determining pricing.
- Different label conditions may exist for the same reference.
- It is the buyer’s responsibility to request recent photographs before placing a final order.
No claims related to the aesthetic appearance of bottles will be accepted.
Our priority is the wine’s preservation and level condition.
We do not sell wines with abnormally low levels, leakage, or signs of deterioration.
The purchase concerns the contents, not the cosmetic appearance of the bottles.
5. Payment
Payments are made in advance through the WINEUPONATIME website by credit card, bank transfer, PayPal, or any other payment option offered.
Payment on invoice via Klarna (up to 30 days) is also available.
For bank transfers, products are reserved for 7 days pending receipt of payment. Bank transfer processing may take 2 to 4 business days.
Goods remain the property of WINEUPONATIME / GRECOR Sàrl until full payment has been received.
6. Shipping & Delivery
Shipping costs are calculated according to the weight of the order and applicable postal rates. Additional packaging or handling charges may apply.
Shipments may be delayed upon request in the event of adverse weather conditions (heatwave or freezing temperatures) to preserve the wine’s quality.
For international shipments, customs duties, local taxes, VAT, and import fees may apply.
These charges are entirely the responsibility of the buyer.
Once the order is handed over to the carrier, a tracking number is provided. The buyer is responsible for tracking and ensuring receipt of the shipment.
In case of export, customs authorities may contact the buyer for additional information.
WINEUPONATIME cannot be held responsible for delivery failures due to customer inaction, incorrect information, or postal service error. If a parcel is returned to us, we reserve the right to retain handling and compensation fees.
7. Return, Cancellation & Claims
No claims will be accepted for bottles affected by cork taint or other ageing-related sensory variations.
Orders are firm and final. No right of withdrawal or cancellation applies.
In accordance with Article 16(c) of Directive 2011/83/EU, the right of withdrawal does not apply to rare wines, investment-grade wines, collectible bottles, and old vintages subject to market fluctuations.
In the event of a return exceptionally authorised, all return costs (transport, insurance, taxes, customs) are the responsibility of the buyer. Returned products must be in their original condition. Any depreciation may be deducted from the refund.
WINEUPONATIME reserves the right to cancel an order prior to shipment in case of:
- stock inconsistency,
- logistical impossibility,
- incomplete or inconsistent customer information,
- suspicion of fraud.
In such a case, the buyer will be refunded in full using the original payment method, unless otherwise agreed.
8. Data Protection
WINEUPONATIME complies with Swiss data protection law.
Personal data voluntarily provided by the buyer may be stored and used for order processing and commercial communication unless the buyer opts out.
Reasonable technical and organisational measures are applied to protect personal data, without guaranteeing absolute security due to the inherent risks of internet communication.
Data is not shared with third parties except when legally required.
9. Intellectual Property
All content on the website is the exclusive property of WINEUPONATIME / GRECOR Sàrl.
No content may be reproduced without prior written authorization.
Unauthorized use may result in legal action.
10. Offer Validity
All products listed are subject to availability.
We reserve the right to modify products, prices, and terms at any time and without notice.
11. Governing Law
The relationship between WINEUPONATIME and its clients is governed by Swiss law.
By confirming the order, the buyer acknowledges providing accurate personal information and accepting these Terms and Conditions.
12. Jurisdiction
Any dispute shall be submitted to the exclusive jurisdiction of the courts of the Canton of Valais (Switzerland).
